Booking Agreement Terms and Conditions

Beyond the Fifth, an affiliate of MavenLuxe Travel, is a boutique travel agency designing intentional and immersive experiences for discerning travelers who value luxury, culture, and connection. The terms “we,” “us,” “our,” and “Beyond the Fifth” refer to Beyond the Fifth, a Wyoming company. The terms “you” and “traveler” refer to the client and all members of their party who book travel services with us.

By engaging our services and paying a planning fee, you agree to be bound by the terms outlined in this Agreement, along with any additional documentation we provide and any applicable supplier terms and conditions. This Agreement contains important legal provisions, including liability waivers, arbitration and class action waivers, and choice of law. Please read it carefully. If you do not agree with any part of the Agreement, you should not proceed with a booking.

These Terms and Conditions may be amended at any time. Material changes will be communicated, and your continued use of our services constitutes acceptance of the updated terms. You agree that any violation of these terms may result in cancellation of your reservation without refund.

You represent and warrant that:
You are of legal age and authorized to enter into this agreement;
You are acting on behalf of all travelers included in the booking;
All information provided is accurate.

Research & Design Fee
We specialize in custom, high-touch travel planning. To support the extensive consultation, research, and support involved, Beyond the Fifth charges a non-refundable Research & Design Fee. This fee is separate from any costs paid to suppliers and reflects the value of our professional time, insight, and logistical support.
Included Services:

• Direct access to your travel advisor by email and scheduled calls
• Responses within 48 business hours
• Custom itinerary app with full trip details
• Dining recommendations, concierge reservations, and in-travel support
• Two itinerary revisions before first deposit is made

Pricing: Price quotes are applicable to the date and time at which they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and International credit card issuer fees. Beyond the Fifth is not responsible for any increases due to fuel surcharges, government imposed taxes/fees or supplier-imposed increases.  Please note: Many of our preferred partners and suppliers offer exclusive, contracted rates that are not publicly available and are therefore presented as a package. In these cases, itemized cost breakdowns may not be provided in order to honor supplier confidentiality. We only work with trusted providers whose pricing reflects quality, value, and seamless execution of service.

Booking & Payment
Your trip is confirmed once we receive your initial deposit. Some suppliers may require payment in full at the time of booking.
Deposits: Non-refundable unless stated otherwise in the supplier’s Terms & Conditions.
Final Payment: Due 60 days prior to departure unless otherwise noted. For bookings made within 60 days of travel, full payment is due immediately. Late payments are subject to a $25 per-person fee.
Beyond the Fifth reserves the right to cancel unpaid bookings, with applicable penalties.

Payment Methods

• Credit Card Authorization: You may be asked to complete a secure authorization form allowing us to process payments on your behalf. This affirms your acceptance of supplier policies. Improper chargebacks (e.g., those due to non-refundable terms or buyer’s remorse) will be disputed

• Direct Invoice: All invoicing is managed by Mavenluxe Travel, and you may receive a payment link or invoice from MavenLuxe Travel. Accepted payments: credit card (3% fee), Zelle, check, wire.

Rates are not locked until payment is processed. You must review all documentation upon receipt for accuracy. It is your responsibility that ensure legal names match government-issued ID exactly. Final documents and confirmations are not issued until full payment is received

Scope of Services
Beyond the Fifth does not own or operate the travel products you book (e.g., flights, hotels, tours). We act solely as your agent in facilitating those arrangements with third-party suppliers. All interactions with suppliers are at your own risk, and you are bound by their terms.

Cancellations & Changes

• Amendments: A $25 fee applies for any requested changes to confirmed land arrangements. Some components (such as airfare) may be non-changeable, depending on supplier policies.
• Voluntary Cancellations: Must be submitted in writing. Cancellations are subject to both supplier penalties and a $200 Beyond the Fifth cancellation fee.
• Refunds: Processed only after all applicable supplier refunds are received and administrative fees are applied. This process may take up to six weeks or longer in some cases.
• Force Majeure: No refunds will be issued for disruptions resulting from force majeure events, including but not limited to acts of God, government actions, natural disasters, pandemics, or terrorism.

Travel Insurance
Beyond the Fifth strongly recommend purchasing a Travel Protection Plan that includes Trip Cancellation, Medical Coverage, and Cancel for Any Reason (CFAR) benefits. Declining insurance may result in total loss of investment in the case of cancellation or emergency.
Beyond the Fifth is not a licensed insurance provider and cannot advise on coverage specifics. For policy questions, consult your insurer directly.

Documentation
Travelers are responsible for securing valid passports, visas, vaccinations, and any testing requirements. Passports must be valid for at least 6 months beyond your return date. Beyond the Fifth is not liable for denied boarding or entry due to incomplete or incorrect documentation.
Visit travel.state.gov and cdc.gov for the latest travel requirements.

Flight Details & Departure
Reconfirm flights at least 24–72 hours prior to departure. Check-in: 2 hours before domestic flights, 3 hours before international. Certain departure taxes may only be payable in cash at the airport. Baggage
You are responsible for complying with airline baggage rules. Oversized or overweight luggage may incur fees or be refused, especially on small aircraft.

Liability & Assumption of Risk
You agree to release Beyond the Fifth and its affiliates from any liability for:

• Supplier negligence or failure to deliver promised services 
• Delays, changes, or losses outside our control
• Events related to force majeure (natural disasters, strikes, pandemic)
• Missed connections, illness, or injury during travel

You acknowledge travel may involve inherent risks and accept full responsibility for your participation. You voluntarily waive the right to bring claims against Beyond the Fifth arising from travel-related incidents.

Medical Conditions / Disabilities
Please inform us at booking if you have a disability or medical condition requiring special arrangements. We cannot guarantee accommodations abroad will comply with U.S. accessibility standards. Travelers requiring assistance must be accompanied by a companion.

Governing Law & Legal Disputes
This Agreement shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles. All claims shall be brought in Wyoming courts. You agree to waive the right to a jury trial and to participate in class actions.
You agree not to sue Beyond the Fifth without first providing written notice of claim within 30 days of your return or cancellation.

Severability
If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions remain in effect.
This Terms & Conditions Agreement is effective as of the date of your first payment or signed agreement with Beyond the Fifth. Please retain a copy for your records. If you have questions, contact us before booking.
